Self-proving Affidavit Form - Virginia

Individuals based in Virginia may use a Virginia Self-Proving Affidavit Form to verify a person’s last will. The verification concerns the genuineness of the will and the confirmation that the person signing the will did so completely voluntarily. The biggest plus of using this document is that it results in speeding up the probate process which takes up a large chunk of time.

As a Virginia Self-Proving Affidavit requires witnesses to also sign the document, the witnesses benefit from not turning up at court after the passing of the person that made the will. In Virginia, the law states two individuals should carry out this role. All involved individuals must then sign the document before a notary public. Once this is done, the notary can complete the notarization of the document by attaching their seal and signature. After this is done, the Self-Proving Affidavit can be bound to the will and it will come into force on a legal basis.
